Maker Verified Terms of Use
These Terms of Use govern access to and use of makerverified.com and related websites, registry pages, application portals, reporting forms and digital services operated by Maker Verified.
1. Acceptance of Terms
By accessing or using the website or related services, you agree to these Terms of Use. If you do not agree, do not use the website or services. Separate Certification Agreements govern applicants and certified artists. If a Certification Agreement conflicts with these Terms regarding participation in the certification program, the Certification Agreement controls.
2. Eligibility and Minors
The website is intended for adults and business users. You must be at least eighteen years old or the age of legal majority where you live to submit an application, report, agreement or other legally binding communication. The website and certification program are not directed to children under thirteen.
3. Purpose of the Website
The Maker Verified website provides information about the Maker Verified Standard, artist certification, the certification process, the public registry, certification documents and related educational resources. The website is intended to promote transparency concerning human creative authorship and the processes represented by certified artists.
4. Informational Nature of the Registry
The public Maker Verified Registry displays certification information as of the status date shown. Users should verify current certification status through the official registry rather than relying on screenshots, copied Mark files, third-party listings, social-media claims or expired certificates. Registry information is provided for verification and informational purposes. Maker Verified may update a listing to reflect an active, under-review, suspended, expired, surrendered or revoked status when appropriate.
5. Scope of Certification
Maker Verified certification applies to the approved artist, professional name and disclosed creative process reviewed through the certification program. Certification is not individual-work inspection, authentication, appraisal, copyright determination, title verification, legal approval, product-safety testing or government endorsement. It does not guarantee artistic quality, originality, ownership, legality, condition, value, future compliance or the absence of intentionally concealed information. Website and registry users remain responsible for their own purchasing, licensing, legal and due-diligence decisions.
6. Intellectual Property
The Maker Verified website, name, certification marks, logos, seals, badges, standards, documents, registry design, text, graphics, forms, software and related content are owned by Maker Verified or used with permission and are protected by applicable intellectual-property laws. No right to use the Maker Verified name, Mark, certification status or certification materials is granted through general use of this website. Authorized use requires active certification and compliance with the applicable Certification Agreement and Mark Usage Guidelines. Website content may not be copied, altered, distributed, sold, republished or used to create a competing or confusingly similar certification system except as permitted by law or authorized in writing by Maker Verified.
7. Prohibited Conduct
You may not:
- Copy, alter, sell, distribute or display a Maker Verified Mark, certificate or certification claim without authorization.
- Create fake certificates, registry pages, certification numbers, badges, seals or confusingly similar certification materials.
- Misrepresent your own or another person’s certification status or the scope of certification.
- Scrape, harvest or collect registry, applicant or user information for unsolicited marketing, profiling, resale or another unauthorized purpose.
- Submit false applications, fabricated evidence, impersonations, malicious reports or knowingly false information.
- Attempt to bypass security, interfere with website operation, introduce malicious code or access nonpublic records.
- Use the website or certification program to violate applicable law, intellectual-property rights, privacy rights, contractual duties or the rights of another person.
8. Reports and User Submissions
You may submit a good-faith concern through the official Maker Verified reporting process. You represent that information submitted is accurate to the best of your knowledge and that you have the right to provide the material. Do not submit harassment, knowingly false allegations, unlawful recordings, stolen records, privileged material, malicious code or personal information unrelated to the concern. You grant Maker Verified a limited, nonexclusive license to review, store, reproduce internally and use submitted material as reasonably necessary to evaluate, investigate, document and resolve the concern, protect the certification program, enforce applicable requirements and comply with law. A submitted concern does not itself establish wrongdoing. Maker Verified is not required to investigate every submission or disclose confidential application, review or investigation details.
9. Third-Party Services and Links
The website may use or link to third-party services, including hosting, forms, electronic signatures, scheduling, video conferencing, email, cloud storage, analytics, social media and payment processing. Maker Verified does not control third-party services and is not responsible for their independent content, availability, security, terms or privacy practices. Your use of a third-party service is governed by the terms and policies of that provider.
10. No Professional Advice
Website and registry content is provided for general informational purposes. It does not constitute legal, tax, financial, investment, insurance, appraisal, authentication or other professional advice. You should consult an appropriate qualified professional regarding decisions requiring professional advice.
11. Disclaimers
To the fullest extent permitted by law, the website, registry and related services are provided “as is” and “as available,” without express or implied warranties. Maker Verified does not warrant uninterrupted access, error-free operation, continuous availability, complete detection of misconduct, the accuracy of information intentionally concealed or later changed by a certified artist or the reliability of third-party services. Certification decisions are based on information reasonably available through the application and review process. Maker Verified does not observe every creative act, inspect every work or guarantee that a certified artist will remain compliant at all times.
12. Limitation of Liability
To the fullest extent permitted by law, Maker Verified and its owners, officers, employees, contractors, agents, affiliates, licensors, successors and assigns will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for lost profits, revenue, business, opportunities, goodwill, reputation or data arising from or relating to website use, registry reliance, certification status, a purchase, a third-party claim or third-party conduct. To the fullest extent permitted by law, Maker Verified’s total aggregate liability to a website user arising from or relating to these Terms, the website, registry or related public services will not exceed one hundred dollars ($100.00). These limitations apply regardless of the legal theory asserted but do not limit liability that cannot lawfully be limited or excluded.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Maker Verified and its owners, officers, employees, contractors, agents, affiliates, licensors, successors and assigns from third-party claims, demands, liabilities, damages, losses, settlements, penalties, costs and reasonable attorneys’ fees arising out of or relating to:
- Your misuse of the website, registry or related services.
- Your unauthorized or misleading use of certification materials.
- Information or material you submit that is false, unlawful, infringing or misleading.
- Your violation of these Terms or another person’s rights.
- Your violation of applicable law.
14. Changes and Availability
Maker Verified may update the website, registry, certification standard, public services or these Terms. Material changes to these Terms will be posted with a revised effective date. Continued use of the website after revised Terms become effective constitutes acceptance of the updated Terms. Maker Verified may modify, suspend or discontinue website features when reasonably necessary, subject to applicable contractual obligations.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising out of or relating to these Terms, the Maker Verified website, registry or related services must be brought exclusively in a state court located in Travis County, Texas, or, when federal jurisdiction exists, in the applicable United States District Court serving Travis County, Texas. You and Maker Verified consent to the personal jurisdiction and venue of those courts.
16. General Terms
Failure or delay in enforcing a provision does not waive the right to enforce it later. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or severed if modification is not possible. The remaining provisions will remain in effect. These Terms, together with any policies incorporated by reference, constitute the agreement governing general use of the website and related public services. Separate agreements may apply to certification applicants, certified artists, service providers and other program participants.
